More & More Massachusetts Wage Law Claims

Employees and ex-employees are suing under the Massachusetts Wage Act and a recent decision clarifies what all they can collect in such suits.

In Wessell V Mink Brook Associates, Inc. the Appeals Court said

  • For wage claims under MGL §148 an employee may recover earned wages that an employer has withheld.

  • For retaliation claims under MGL c §148A, an employee terminated by an employer for asserting a wage right may recover damages stemming from the termination.

  • Damages for retaliation may include earnings from the date of termination up to trial.

The employer fired a worker in retaliation for her legitimate demands for under the Wage Act. The jury was allowed to award damages from the violation right up to the verdict.
